What it requires

A service is any self-employed economic activity normally provided for remuneration; financial, electronic communications, transport, temporary work agency, healthcare, audiovisual, gambling, official authority, certain social, private security and notarial services are excluded (reg 2). A provider makes available contact details — a postal address, fax number or email address, a telephone number and any official address — to which recipients can send a complaint or request for information (reg 7). A provider makes available to a recipient its name; legal status and form; the geographic address at which it is established and details for rapid, direct contact, including electronic contact; any trade or similar public register it is entered in, with its registration number; where the activity is subject to VAT, its VAT registration number; any professional body and professional title for a regulated profession; its general terms and conditions and any contractual terms on applicable law or competent courts; the existence of any after-sales guarantee not imposed by law; the price, where the provider pre-determines the price for a given type of service; the main features of the service, if not apparent from the context; and details of any professional liability insurance or guarantee it is required to hold, including the insurer's contact details and territorial cover (reg 8(1)). Information is made available if supplied on the provider's initiative, easily accessible where the service is provided or the contract concluded, accessible electronically at an address the provider gives, or included in an information document describing the service (reg 8(2)). On request, where the price is not pre-determined, the provider supplies the price or, if an exact price cannot be given, the method of calculating it so the recipient can check it, or a sufficiently detailed estimate (reg 9(1)(a)). A provider subject to a code of conduct or a member of a trade association or professional body offering non-judicial dispute resolution tells the recipient and says how to access details (reg 10). The information is given clearly and unambiguously and in good time before the contract is concluded or, if there is no written contract, before the service is provided (reg 11). The provider responds to complaints as quickly as possible and makes its best efforts to find a satisfactory solution, except to vexatious complaints (reg 12). WATCH — the Provision of Services (Amendment and Transitional Provision) Regulations 2026 (S.I. 2026/435), in force 1 October 2026, substitute the definitions of provider and recipient in reg 4, omit reg 5(3)–(5) and reg 13 and change the authorisation scheme provisions; they do not amend regs 7–12. Extends to the whole United Kingdom.
