1. Who we are
These terms apply to purchases from kubitdocs.com, operated by KubitDocs Ltd, company number [NUMBER], registered office [ADDRESS], email [EMAIL].
2. What you are buying
You are buying downloadable document templates in fillable PDF format. You will need software able to open PDF files. Files are delivered by download link immediately after payment and by email. There is no physical product and nothing will be posted to you.
3. What the templates are, and what they are not
Our templates are a starting point that you must adapt to your own project, site and activities. They are not completed documents and they are not professional health and safety advice. Assessment bodies and principal contractors generally require documentation that is specific to the project it relates to, and a template used without adaptation may not be accepted. You remain responsible for the suitability, accuracy and legal compliance of any document you produce using our templates, and for meeting your own duties under health and safety law.
4. Licence
On payment you receive a perpetual, non-exclusive, non-transferable licence to use, edit and reproduce the templates within your own business, including on projects you carry out for your clients. You may not resell, redistribute, sub-licence, publish or share the templates, whether edited or unedited, whether for payment or free of charge. You may not incorporate them into any product or service offered to third parties as templates. The copyright in the templates remains ours.
5. Price and payment
Prices are shown on the product page and [include / exclude] VAT. Payment is taken at checkout. Your order is accepted when we send your confirmation email.
6. Your right to cancel, and how it is lost
If you are a consumer you normally have 14 days to cancel a distance purchase. Because our products are downloaded immediately, we ask you at checkout to consent to the download starting straight away and to acknowledge that, once it does, your right to cancel is lost. If you give that consent and the download begins, you will not be able to cancel. If you would rather keep the cancellation right, do not tick the box and contact us instead.
7. Faults and your statutory rights
Losing the cancellation right does not affect your legal rights. If a file is faulty, does not match its description, or is not fit for a purpose you told us about before buying, you are entitled to a repair or replacement and, if that is not possible or not provided within a reasonable time, to a price reduction which may be the full amount. If we did not have the right to supply the content, you are entitled to a full refund. We cannot exclude or restrict these rights and we do not try to.
