What it requires
s.1(1) — no child shall be employed in any industrial undertaking. "Industrial undertaking" takes its meaning from Part I of the Schedule (s.4), which includes the construction, reconstruction, maintenance, repair, alteration or demolition of any building, railway, road, tunnel, bridge, sewer, drain, electrical undertaking, gaswork, waterwork or other work of construction, and the preparation for or laying of the foundations of any such work (Schedule Part I Article 1(c)). The Act's own definition of "child" was repealed for England and Wales by the Education Act 1944; the operative rule is now Education Act 1996 s.558 — for any enactment prohibiting or regulating the employment of children or young persons, a person who is not over compulsory school age is deemed a child (register entry education-act-1996). The Schedule's Article 2 age of fourteen is the text of the 1919 Convention the Act implements; it does not set the age in s.1(1). A "young person" is someone who has ceased to be a child and is under 18 (s.4). s.1(4) — where persons under 16 are employed in an industrial undertaking, a register of them and their dates of birth is kept and open to inspection at all times. Outside mines, quarries and factories, the Children and Young Persons Act 1933 ss.21 and 28 (or the Scottish and Northern Ireland equivalents) apply to employing a child in breach of the Act, and failing to keep or produce the register is a summary offence (s.1(6)). Work experience arranged by a local authority or school in the last two years of compulsory schooling is excepted by Education Act 1996 s.560.
