What it requires
s.1 — a worker who is working, or ordinarily works, in the United Kingdom and has ceased to be of compulsory school age must be paid at least the national minimum wage for each pay reference period, at the hourly rate prescribed by regulations (the rates and the National Minimum Wage Regulations 2015 were not read). s.9 — employers keep and preserve the records the regulations prescribe. s.10 — a worker who reasonably believes they have been underpaid may, by a production notice, require the relevant records to be produced within 14 days. s.17 — an underpaid worker is entitled to the higher of the shortfall and the shortfall uprated to the current rate. s.31 — refusing or wilfully neglecting to pay the minimum wage, failing to keep or preserve records, and false entries or information are offences, with a due diligence defence; conviction for refusal or wilful neglect is a mandatory exclusion ground under the Procurement Act 2023 (Schedule 6 para 21).
