What it requires
A commercial organisation — a body corporate or partnership, wherever formed, carrying on a business in any part of the UK — that supplies goods or services and has a total turnover of not less than £36 million (SI 2015/1833 reg 2; turnover includes that of its subsidiary undertakings, after trade discounts, VAT and other turnover taxes, reg 3) must prepare a slavery and human trafficking statement for each financial year. The statement sets out the steps taken during the year to ensure slavery and human trafficking is not taking place in any of its supply chains or its own business, or states that no such steps have been taken. It may cover the organisation's structure and supply chains, its policies, due diligence, the parts of the business at risk and how that risk is managed, its effectiveness against performance indicators, and staff training (s.54(5)). A company's statement is approved by the board and signed by a director (s.54(6)); it is published on the website with a link in a prominent place on the homepage, or, with no website, provided within 30 days of a written request (s.54(7)–(8)). The duty is enforced by the Secretary of State by civil proceedings for an injunction (s.54(11)). Below the threshold s.54 imposes no duty; a policy produced for pre-qualification is voluntary.
