What it requires
s.11 — any requirement to wear a safety helmet that would otherwise be imposed on a Sikh at a workplace, by any statutory provision or rule of law, does not apply while he is wearing a turban, and neither does any associated requirement (one related to the wearing, provision or maintenance of safety helmets) that would fall on him or on anyone else, such as an employer or principal contractor. A person is not liable in tort for injury, loss or damage caused by not complying with a requirement disapplied in this way. Where a Sikh not wearing a helmet is injured through someone else's act or omission, that person is liable only for the injury he would have suffered had he been wearing one. The exemption does not apply to a Sikh at the workplace to give, or train to give, an urgent response to fire, riot or other hazardous situations, or as a member of or support to the armed forces in a military operation or training, where a helmet is necessary to protect him (s.11(6A)–(6B)). "Workplace" means any premises where work is being undertaken, and has done so since 1 October 2015 (Deregulation Act 2015 s.6); a document must not limit the exemption to construction sites. s.12 — a provision, criterion or practice on wearing safety helmets applied to a Sikh, when there are no reasonable grounds to believe he would not wear a turban at all times at the workplace, is taken to be a proportionate means of achieving a legitimate aim for indirect discrimination under the Equality Act 2010 s.19; special treatment given to a Sikh under s.11 is not direct discrimination against anyone else under s.13 of that Act.
