What it requires

reg 3 — no person may compile, use, sell or supply a prohibited list: a list containing details of people who are or have been trade union members or taken part in trade union activities, compiled with a view to being used by employers or employment agencies to discriminate on those grounds in recruitment or in the treatment of workers. reg 4 sets narrow exceptions (supply without knowledge, public-interest exposure, trade union office requirements, lists required by law, legal proceedings and advice). A person refused employment, or refused an employment agency's services, for a reason relating to a prohibited list may complain to an employment tribunal, and the burden shifts to the employer once facts are shown (regs 5–6).
